Regulatory Updates on Export Controls for Defense Material and Dual-Use Goods

The Spanish system for controlling the export of defense material and dual-use goods is entering a new stage of modernization, aimed at enhancing its efficiency, transparency, and adaptability to the needs of an increasingly dynamic and demanding environment.

Among the main developments is the entry into force of Order ECM/536/2026, which updates the technical control lists and strengthens alignment with European regulations. This update provides greater clarity in product classification, increases legal certainty for operators, and contributes to a more harmonized application of regulatory requirements.

In addition, significant progress continues to be made in administrative management through the digitalization of procedures and the streamlining of processing workflows, which will help reduce response times and improve the experience of exporting companies.

Another key development is the promotion of intra-EU general licenses, a tool designed to simplify the transfer of certain products within the European Union, fostering industrial cooperation and strengthening strategic supply chains.

In parallel, the Administration is working on a new Royal Decree that will update the existing regulatory framework, incorporating improvements aimed at responding more effectively to the risks, challenges, and opportunities of the current international context.

These measures represent a significant step toward a more agile, modern, and efficient control system, while maintaining the necessary balance between security, regulatory compliance, and business competitiveness.
